Terms of Service

1. About Our Practice

Falcon Direct Care, LLC ("Falcons ADHD Plus," "we," "us") is a direct care telehealth practice operated by Nicole Falcon, APRN-FNP-C, licensed in Colorado and North Carolina. We provide clinical services including ADHD management, metabolic wellness, hormone optimization, and peptide therapies.

By scheduling an appointment, completing an intake form, or accessing our services, you agree to these Terms of Service.

2. Cash-Pay / No Insurance

Falcons ADHD Plus is a 100% cash-pay practice. We do not bill, accept, or interact with any private insurance, Medicare, or Medicaid. By engaging our services you acknowledge:

• All fees are due at the time of service
• We do not submit claims to any insurance carrier on your behalf
• We can provide a superbill or receipt upon request — you may attempt to seek reimbursement from your insurer independently, but we make no guarantees of coverage
• Payment is processed through Bluefin, a PCI-DSS compliant processor

3. Telehealth Consent

All clinical encounters are conducted via telehealth. By scheduling a visit you consent to:

• Receiving healthcare services through electronic communications (video, phone, or secure messaging)
• Understanding that telehealth has limitations versus in-person care
• The possibility that technical failures may interrupt a session — in such cases we will reschedule promptly
• Telehealth services being subject to the laws of the state in which you are located at the time of service

You have the right to withdraw telehealth consent at any time by notifying us in writing. Withdrawal does not affect previously rendered services.

4. Controlled Substance Policy

Prescribing of controlled substances (including stimulant medications) is governed by federal DEA regulations and applicable state law. Patients receiving controlled substance prescriptions agree to:

• Comply with our controlled substance agreement, signed at intake
• Consent to PDMP (Prescription Drug Monitoring Program) review at each visit
• Maintain one prescribing provider relationship for controlled substances
• Not request early refills except in documented extenuating circumstances
• Safeguard all medications to prevent loss, theft, or diversion

We reserve the right to discontinue controlled substance prescribing and/or the patient relationship if diversion, misuse, or violation of this agreement is identified.

5. Compounding Medication Disclaimer

Some medications prescribed by Falcons ADHD Plus (including semaglutide, tirzepatide, and certain peptides) are compounded by licensed 503A sterile compounding pharmacies. These formulations:

• Are not FDA-approved brand-name drugs
• Are legally prepared by state-licensed, PCAB-accredited compounding pharmacies
• Are prescribed for your individual clinical needs
• May differ in formulation from commercially manufactured products

6. Appointment & Cancellation Policy

• Appointments must be cancelled at least 24 hours in advance to avoid a late cancellation fee
• No-shows may be charged a no-show fee at our discretion
• Repeated no-shows may result in discharge from the practice
• We will make reasonable efforts to accommodate rescheduling

7. Scope of Service & Limitations

Falcons ADHD Plus provides ongoing chronic condition management via telehealth. We do not provide:

• Emergency or urgent care services
• In-person physical examinations
• Inpatient psychiatric services
• Workers' compensation evaluations or disability documentation
• Expert witness services

8. Patient Responsibilities

• Provide accurate and complete health information
• Disclose all current medications and supplements
• Notify us of any changes in your health status between visits
• Maintain updated contact and payment information
• Communicate respectfully with all practice staff

9. Discharge from Practice

We reserve the right to discharge a patient from the practice with appropriate notice (30 days for non-emergency situations, immediate for safety concerns). Grounds include but are not limited to: abuse of staff, violation of controlled substance agreements, non-payment, or consistent no-shows.

10. Governing Law

These Terms are governed by the laws of the State of Colorado. Disputes shall be resolved in Denver County, Colorado. Patients receiving services while located in North Carolina acknowledge that applicable NC telehealth laws also apply to those encounters.

11. Changes to Terms

We may update these Terms at any time. Continued use of our services following notice of changes constitutes your acceptance.
